As a condition of receiving Federal funds, the Federal-Aid Highway Act of 1968, Section (22)a required each State Highway
Agency (SHA) to sign Equal Employment Opportunity (EEO) assurances.
These signed assurances became the basis for each SHA (hereinafter referred to as State Transportation Agency, i.e., “STA”) to
develop and administer an EEO Program in accordance with Federal Highway Administration (FHWA) prescribed regulatory requirements
under Title 23, Code of Federal Regulations (CFR), Section 230-Subpart C and Appendix.
The Provisions of Subpart C are applicable to all STAs that receive Federal financial assistance in connection with the Federal-aid
highway program. Appendix A to Subpart C requires that the EEO program address Part II-SHA Employment. Under this part, the
development and implementation of an Internal EEO program, also known as an Affirmative Action (AA) plan and program, is required.
